Christie C | Is it legal for a company to make 5 month late deductions? |
I signed up for flex medical and flex daycare, my job started deductions in August, we began school in July and received 2 checks prior. I filled out an enrollment sheet for flex which stated the amount and number of pays the deductions would be spread out under. They emailed me today about something I hadn't noticed, they never started deductions, my flex medical was 500 and flex daycare 5000, they would like to take out 416 per paycheck for the remainder of my contract to June. Is this legal for them to do, it is over 800 per month which is almost a full paycheck for me? I can't afford the deductions of that amount, I agreed to deductions from the beginning. Additional Details I hadn't noticed it because we begin our new school year in July but when we start the checks already have a year to date amount that the had flex m( for medical) and flex d( for daycare) with amounts listed and to be honest never looked super close from check to check. As far as the deductions, we have already used the flex daycare and been reimbursed, from the outside company that provides the services to my work company, and on top of it, today she said she saw that I hadn't used the daycare yet, and I argued with her that yes, we had because we had already received checks for reimbursement. She even admitted someone messed up putting it in. What should have come out to about 200 a paycheck is going to come out over 400 a paycheck which is not what I signed up for. |

What a mess. Tell them that you want what you signed up for. Also, in some plans, if you don't use ALL the $ in the plan before year end, you lose it! You need to read the plan documents and be sure the $ rolls over into the new year. If it doesn't, why would you agree to play catch up for the next six months? Would you spend all the $ in the plan by then?
I would register a complaint in writing, and demand that this be cleared up. You be sure to leave a paper trail, that way you have recourse. If you wind up investing $3000 instead of $5000 this year, maybe that is the best you can do, under the circumstances. You can change the amount next June. Good luck. Obviously, their solution won't work for you, since you can't afford to lose a paycheck a month for the next half year, so talk to them about a reasonable solution, and salvage what you can. |

You should have checked your paycheck over. Sorry.
It's kinda like, the electric company forgets to bill you for five months, does that mean they can't? Nope, they'll just do it all at once, or "catch up" basis. |

Why did you not point it out earlier?
You can let them do it or not. If you choose not to you will not be able to get all the amount back.
If they take out $416 each paycheck you should be able to submit your expenses and get it back right away. You would not be out that money for very long.

They can't wait until next year to deduct the amounts, because of the tax implications. There are very specific IRS regulations about pre-tax spending accounts.
Its not even close to the same thing as purchasing merchandise in a store. You are having money withdrawn and placed in a separate account for your own family's use. Basically, you're paying yourself...the money is just being moved from one source (your paycheck) to another (your spending account).
You also share some responsibility in this mess for not noticing that the deductions weren't being taken out...especially since you have already used money from the accounts. Employees do have a responsibility to periodically review their own pay stubs.
You say that these extra deductions will work out to an additional $200 a paycheck. I'm confused as to how you could not notice that you had an extra $400 a month during the time the deductions weren't being taken??
Anyhow, due to the way pre-tax spending accounts are regulated through the IRS, I don't think there's much you're going to be able to do about this. You can consult an attorney who has a background in tax or benefit laws, if you want to confirm for sure. But I'm fairly certain they will tell you the same thing. |
