Consult an experienced bankruptcy lawyer. You file a petition with documents listing your assets and their values, your debts and their balances (you can't leave any out or you risk losing your discharge) and some financial history along with income and expenses, all on forms available from most bankruptcy courts for free or purchased from bookstores or business supply stores.

If you cannot pay your debts as they come due, you are bankrupt. Consumer debt consolidation places actually create preferences (not good) by treating every creditor differently, and some are just scams. If you go to or call a consumer debt counseling/consolidation operation, make sure it is one approved by the United States Trustee office.

You find a good bankruptcy office and go through them. It does cost to file the papers. They take your tax return, it costs me $150 a month to pay them off for their fees. Your bank account could get suspended, at least your overdraft taken away at very least.
It's worth it though if your really struggling. I'd rather have my debt dealt with and have to pay $150 a month, than have collectors calling making a bigger problem with my credit.

Here are some of the cons of declaring bankruptcy:

A bankruptcy stays on your credit report for 10 years, making it difficult to acquire credit, buy a home or car, get life insurance, or sometimes get a job.

A recent bankruptcy makes it nearly impossible to get a mortgage (although you should be able to do so within about five years).

Not all debts may be "discharged" in a bankruptcy. Student loans and back taxes (within 3 years) are prime examples.

You will lose all your credit cards (unless you pay them off before filing.) You may also have to give up some luxury possessions.

You will have to explain to a judge or trustee how you got into a financial mess.

It will be a long time before you are able to get credit cards again.
