My landlord is borderline harassing us we want out but don't know how to get our deposit back and avoid paying?
We signed the lease in September as 3 female adults. The property manager was the nephew of the Landlord. He never said there would be any crazy rules.
The landlord just fired her nephew and now came to our place, 1 female roommate moved out and 1 male moved in.
The nephew property manager and the landlord agreed the new roommate we chose didn't have to sign anything.
Now the landlord came over for an "inspection" 3 months into our lease and saw the guy living with us. She is upset that we have a male. She told us he has to leave right away. And that were not allowed to have any males living with us.
So we told her he was here just for Christmas as a visitor. She doesn't believe us even though this guy only has a fold up cot, alarm clock and 1 bag of clothes!!
She also said NO MALE FRIENDS ARE ALLOWED OVER. NO MALE HOUSE GUESTS. Even though the lease says we can have guests up to a month in the place. She won't stop calling to see if we have gotten him to leave yet. She also Threatened to raise the rent from 1250 to 2000 if the male stays.
Our lease agreement says nothing about raising the rent which means in the Calgary Tenant Laws, she cannot raise the rent at all.
She now wants us to sign some paper "written agreement" that we will not have males over or living with us.
She is also upset that two females are living in one room even though we are a married lesbian couple of 3 years. She says she doesn't understand and that we should be in separate rooms.
We need some advice! We want out of this place but don't want to lose our deposit or have to pay the full amount of the lease that's left!! What can we do?!
We live in Calgary Alberta Canada.

Most landlord changes has to be in a contract written change with reasonable notice. You probably should go to the tenant law representative in Calgary and get this straightened out once and for all.
Then maybe you can get your money back. Next time inform your new landlord you would like everything in writing especially changes!!! Good Luck!

Ok I understand what you are going through. My 2 year old son and me asked 2 move just because my son was black white and mexican. Although I had no income and needed my deposit back I said to myself "Is the money really worth it" as I looked at my son crying because I was stressed to the max. Money comes and goes for me and i never know when I will have any at all. But is what I do have is the understanding that my health is more important than someone else's ways of control. Don't give up!! Your not giving up if you take your own control of your life. Let it go I did with nothing. But I say if you get some advice that gets it back go for it. Good Luck! - R. 1-877-427-4088 is Service Alberta Consumer Contact Centre's number. If they cannot answer your questions, and give you advice, they should be able to refer you to an agency that can.

Unless your lease specifically addresses subleasing _and_ allows it, you **should** have gotten something from your landlord (or the person authorized to act on their behalf) stating you could just move somebody in. Even if/when verbal agreements are legally binding, they're difficult to prove. I'm not knocking you for not getting something in writing, but I cannot stress the importance/value of doing so in the future! A "paper trail" is invaluable when it comes to your protection, and your peace of mind. ALSO, grab a sheet of paper, and document the harassment. From this point on, if she says something that crosses the line, write it down, along with the date and time. You can also write down what she's said in the past. This may aid you at some point.

That said, your landlord is nucking futs. Not being a Canadian, I'm not sure what, if any, protections are extended under the law to people on the basis of sexual orientation and the like, but if you've got a community group that deals with LGBT issues and advocacy, I'd turn to them as well, and see what they suggest.

I know it's probably stressful and somewhat frightening right now, but keep your head up. Get in touch with the SACCC, and you should be fine. GOOD LUCK! ♥

Sounds like a clear case of harassment. Get an attorney have them write a letter to her and that should help the situation. I would consider moving though when the lease is up. Good luck to you!
